Terms of Sale

1. Introduction

These Terms of Sale apply to the purchase and use of tickets to concerts, tours, festivals, events and other live entertainment events promoted, presented or operated by Teamwrk Touring.

Teamwrk Touring Pty Ltd (ABN 42 669 054 317, ACN 669 054 317), trading as Teamwrk Touring, we, us or our, is a live event promoter.

By purchasing, holding, using or attempting to use a ticket to a Teamwrk Touring event, you agree to be bound by these Terms of Sale.

These Terms of Sale apply to the original ticket purchaser and to any person who later holds or uses a ticket.

2. Other terms that may apply

In addition to these Terms of Sale, your ticket and attendance may also be subject to:

• any event-specific terms published on the Teamwrk Touring website, ticketing page or event page;
• the authorised ticketing agency's terms and conditions;
• the relevant venue's conditions of entry;
• any artist, promoter, sponsor, VIP package or partner terms that apply to the event; and
• any applicable laws, regulations, codes, public health directions or safety requirements.

If there is any inconsistency between the relevant terms, the following order will apply to the extent of the inconsistency:

• applicable laws and mandatory consumer rights;
• venue conditions of entry;
• event-specific terms;
• these Terms of Sale; and
• authorised ticketing agency terms.

We may cancel or refuse to honour a ticket that has been purchased, obtained, used, transferred, resold or advertised in breach of these Terms of Sale or any other applicable terms.

3. Authorised ticketing agencies

Tickets to Teamwrk Touring events should only be purchased through the authorised ticketing agency or official ticketing link listed on our website, event page, venue page or official communications.

You should not purchase tickets from unauthorised sellers, resale platforms, social media pages, classifieds, auction sites or unofficial third parties unless that resale is expressly authorised by us, the venue or the relevant ticketing agency.

If you purchase a ticket from an unauthorised seller, you do so at your own risk. We cannot guarantee that the ticket will be valid, that you will be admitted to the event, or that you will be eligible for assistance, replacement or refund.

4. Ticket purchase limits

We may set ticket purchase limits for certain events, ticket types, presales or promotions.

We reserve the right to cancel any tickets purchased in excess of published limits, including tickets purchased through multiple accounts, names, email addresses, IP addresses, payment methods or other details that appear to be connected.

Where tickets are cancelled under this clause, refunds will be handled in accordance with applicable law and the relevant ticketing agency's process.

5. Use of tickets

Tickets are for personal use only unless otherwise authorised by us in writing.

Tickets must not be used for advertising, promotions, competitions, giveaways, fundraising, trade promotions, hospitality packages, travel packages or other commercial purposes without our prior written consent.

You must not resell, offer for resale, advertise, transfer or deal with tickets in breach of any applicable resale laws, ticketing agency terms, venue terms or event-specific terms.

We may cancel any ticket that is sold, advertised, transferred, used or obtained in breach of this clause.

6. Event-specific terms

Some events may have additional terms, including age restrictions, venue rules, ticket limits, VIP package conditions, set time conditions, security requirements, accessibility conditions, resale restrictions or entry requirements.

Event-specific terms may be published on the Teamwrk Touring website, the event page, the authorised ticketing agency's website, the venue website or in official event communications.

You are responsible for reviewing any event-specific terms before purchasing tickets and before attending the event.

7. Event changes

We may add, remove, reschedule, substitute or change event details where reasonably necessary.

This may include changes to support acts, line-ups, advertised performers, set times, event times, doors times, prices, venues, seating arrangements, ticket allocations, audience capacity, production, staging or event format.

For festivals or multi-artist events, line-ups and set times are subject to change.

Where an event is cancelled, rescheduled or significantly relocated, refunds or exchanges will be handled in accordance with applicable law, the Live Performance Australia Ticketing Code of Practice where applicable, these Terms of Sale and the relevant ticketing agency's process.

8. Cancelled, rescheduled or significantly relocated events

If an event is cancelled, rescheduled or significantly relocated, we will comply with applicable laws and any applicable industry codes.

If an event is cancelled, you will be entitled to a refund in accordance with applicable law and the authorised ticketing agency's refund process.

If an event is rescheduled, your ticket will usually remain valid for the rescheduled date unless otherwise advised. If you cannot attend the rescheduled date, you may be entitled to request a refund within the timeframe notified by us or the authorised ticketing agency.

If an event is significantly relocated, your ticket will usually remain valid for the relocated event unless otherwise advised. If you cannot attend the relocated event, you may be entitled to request a refund within the timeframe notified by us or the authorised ticketing agency.

Refund amounts, timing, booking fees, transaction fees, delivery fees and payment processing will be handled in accordance with applicable law and the relevant authorised ticketing agency's terms and process.

9. Changes outside our control

Events may be affected by circumstances outside our reasonable control.

These may include extreme weather, natural disasters, fire, flood, public health events, communicable disease outbreaks, government directions, venue closures, travel restrictions, transport interruptions, industrial action, technical failures, artist illness, safety issues, security threats, emergencies or other circumstances beyond our control.

Where these circumstances affect an event, we may need to reschedule, relocate, reduce capacity, change the configuration, change entry requirements or cancel the event.

If your ticket is cancelled due to reduced capacity, venue restrictions or safety requirements, you will be entitled to a refund in accordance with applicable law and the authorised ticketing agency's process.

10. Refunds and exchanges

Except as required by law, these Terms of Sale, any applicable industry code or the authorised ticketing agency's terms, tickets are not refundable or exchangeable.

You are responsible for checking all event details before purchasing, including the event, artist, city, venue, date, time, ticket type, age restriction, seating allocation and accessibility requirements.

We are not required to provide a refund or exchange where you:

• change your mind;
• can no longer attend;
• purchase the wrong ticket type, city, date or seating allocation;
• arrive late;
• are refused entry or removed from the event for breaching these Terms of Sale, venue terms or event-specific terms;
• lose, damage or destroy your ticket; or
• purchase a ticket from an unauthorised seller.

Nothing in this clause limits any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.

11. Lost, stolen or damaged tickets

Lost, stolen, damaged or destroyed tickets may not be replaced.

Replacement tickets may be issued at the discretion of the authorised ticketing agency and may require proof of purchase, identification or payment of a replacement fee.

For general admission events, replacement tickets may not be available.

12. Age restrictions

Some events are subject to age restrictions due to venue licensing, legal requirements, artist requirements, safety considerations or event format.

Age restrictions will generally be listed on the relevant event page, ticketing page or venue page.

You are responsible for checking age restrictions before purchasing tickets.

Valid photo identification may be required to enter an event or purchase alcohol. If you do not meet the relevant age restriction or cannot provide acceptable identification, you may be refused entry without refund.

Unless otherwise stated, all patrons, regardless of age, must hold a valid ticket to enter an event.

13. VIP packages and add-ons

Some events may include VIP packages, meet and greets, hospitality packages, merchandise bundles, early entry, ticket upgrades or other add-ons.

VIP packages and add-ons may be subject to additional terms and conditions.

Package inclusions, timings and benefits may vary and may be subject to change where reasonably necessary.

Unless otherwise stated, VIP package merchandise, laminates, gifts or other inclusions have no cash value and cannot be exchanged or refunded separately from the ticket.

Where a VIP package or add-on is provided by a third party, that third party may be responsible for delivering the relevant package or benefit.

14. Entry, security and venue conditions

Entry to an event is subject to these Terms of Sale, event-specific terms and the relevant venue's conditions of entry.

You must comply with all reasonable directions given by Teamwrk Touring, venue staff, security, emergency services, police, medical staff, event staff and authorised representatives.

You and your belongings may be searched before or during entry, including bag checks, wanding, pat-downs, detection dogs or other screening methods permitted by law and venue policy.

If you refuse a lawful or reasonable search, you may be refused entry without refund.

We or the venue may refuse entry or remove you from an event if:

• your ticket is invalid, damaged, altered, duplicated or obtained in breach of these Terms of Sale;
• you cannot provide valid identification where required;
• you are intoxicated, under the influence of illicit substances, aggressive, abusive, threatening, unsafe or disorderly;
• you fail to comply with directions from event staff, security or venue personnel;
• you bring prohibited items to the event;
• you engage in illegal, dangerous, disruptive, offensive or antisocial behaviour;
• you breach venue rules, event-specific terms or applicable laws; or
• we reasonably consider that your entry or continued attendance may affect the safety, security or enjoyment of others.

15. Safety and conduct

You attend events at your own risk.

You must act safely and responsibly at all times.

You must not engage in conduct that may endanger yourself or others, including moshing, crowd surfing, stage diving, climbing structures, throwing objects, forcing entry, entering restricted areas or engaging in violent, reckless or antisocial behaviour.

You should consider whether your health, medical conditions, pregnancy, disability, mobility, hearing, sensory needs or other personal circumstances may be affected by attending an event.

Live music events can involve loud noise, flashing lights, strobe lighting, smoke, pyrotechnics, crowd movement, standing for long periods, weather exposure and other risks.

You are responsible for taking reasonable steps to protect your own safety, including wearing suitable clothing and footwear and using hearing protection where appropriate.

16. Prohibited items

Unless expressly permitted by the venue or event-specific terms, prohibited items may include:

• alcohol, illicit substances or drug paraphernalia;
• weapons, tasers, knives, fireworks, explosives, flares or dangerous items;
• glass, cans, metal containers or hard plastic bottles;
• outside food or drinks;
• professional cameras, detachable lenses, audio recorders, video recorders, drones, tripods, monopods or selfie sticks;
• laser pointers, air horns, whistles, megaphones or other disruptive items;
• large bags, large signs, banners, flags, umbrellas, tents, chairs or sun shelters;
• promotional materials, flyers, stickers, samples or unauthorised merchandise;
• animals, except registered assistance animals where permitted by law and venue policy;
• items that obstruct the view, movement or enjoyment of others; and
• any other item that event staff, security or venue personnel consider unsafe, offensive, disruptive or unsuitable.

Prohibited items may be confiscated and may not be returned.

You should check the relevant venue conditions before attending, as prohibited item lists may vary by venue.

17. Photography, filming and recording

We, the venue, artists and authorised third parties may photograph, film, record, livestream or broadcast the event.

By attending the event, you consent to being photographed, filmed or recorded as part of the audience or event environment.

You agree that we and our authorised partners may use those photographs, recordings and footage for promotional, marketing, archival, editorial, social media, broadcast and commercial purposes without further approval or compensation.

Professional photography, filming, livestreaming, audio recording or broadcast equipment is not permitted unless authorised in writing by us.

Personal photography may be permitted for some events, subject to artist, venue and event-specific restrictions. Flash photography, professional cameras and recording equipment may be prohibited.

18. Personal information

When you purchase tickets or attend an event, we, the authorised ticketing agency, the venue or other event partners may collect personal information about you.

This may include your name, contact details, payment information, ticket details, attendance information and other information reasonably required for ticketing, event operations, safety, security, marketing or legal compliance.

Your personal information will be handled in accordance with our Privacy Policy and the privacy policies of the relevant authorised ticketing agency and venue.

19. Liability for loss, damage or injury

To the maximum extent permitted by law, Teamwrk Touring, its related entities, officers, employees, contractors, agents, artists, venues, sponsors and event partners are not liable for any loss, damage, cost, expense, injury or claim you suffer in connection with your attendance at, travel to or travel from an event.

This includes loss or damage to personal property, travel or accommodation costs, lost income, missed transport, personal injury, illness, disappointment, distress or consequential loss, except to the extent such liability cannot be excluded by law.

You are responsible for your own belongings at all times.

You agree to compensate us for any loss, damage, cost, expense or liability we suffer as a result of your wilful, reckless, negligent or unlawful conduct at an event.

Nothing in these Terms of Sale excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified.

20. Variation of these Terms of Sale

We may update these Terms of Sale from time to time by publishing an updated version on our website.

Changes will apply from the date they are published and will not operate retrospectively.

21. Severability

If any provision of these Terms of Sale is invalid, unlawful or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to apply.

22. Governing law

These Terms of Sale are governed by the laws of Victoria, Australia.

You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.
